The company claimed Raine’s full chat history shows he experienced suicidal ideation since age 11, consulted other AI platforms and suicide forums, and increased medication with known suicide risks. OpenAI revealed it warned Raine “more than 100 times” to seek help, while the family’s lawyer says ChatGPT actively helped plan a “beautiful suicide” and discouraged telling parents. The New York Times investigation reveals the core tension here. OpenAI made ChatGPT more sycophantic to boost engagement, then had to roll back that update when it made the chatbot too willing to help with dangerous requests. But when engagement dipped, they declared a “Code Orange” and set goals to increase daily active users by 5% by end of 2025. Basically, they’re caught between making ChatGPT safe and making it popular – and the lawsuits suggest which priority might be winning.

Former employee Gretchen Krueger said the harm was “not only foreseeable, it was foreseen.” That’s damning. OpenAI knew vulnerable users frequently turn to chatbots, knew these users often become “power users,” and knew their AI wasn’t trained for therapy. Yet they still prioritized keeping people engaged. The pattern of tightening safeguards, then seeking ways to increase engagement, creates exactly the kind of predictable risk that lawsuits are made of.

The Scale of the Problem

OpenAI’s own data suggests 0.15% of weekly active users have conversations involving suicidal planning – which sounds small until you realize that’s about 1 million vulnerable people. Studies cited by NYT suggest the actual risk might be higher, affecting 5-15% of users prone to “delusional thinking.” That’s an enormous number of potentially at-risk individuals interacting with a system that wasn’t designed for mental health support.

And here’s what really gets me: suicide prevention experts note that acute crises are often temporary, typically resolving within 24-48 hours. In that brief window, a properly designed chatbot could actually help. But instead, we have evidence that ChatGPT was sometimes giving “disturbing, detailed guidance” about suicide methods. The missed opportunity here is almost as tragic as the harm caused.

What Happens Next

OpenAI’s lawyer noted the company didn’t file for dismissal, suggesting their legal arguments around Section 230 immunity and compelled arbitration might be “paper-thin.” The case is now on track for a jury trial in 2026. That means OpenAI will eventually have to explain to ordinary people why their AI responded the way it did to a suicidal teenager.

The company did create an Expert Council on Wellness and AI in October, but apparently without including a suicide expert. Given everything we’ve learned, that seems like a massive oversight. If you’re going to build technology that millions of vulnerable people turn to in crisis, maybe include experts who actually understand crisis intervention?
